Renewal of Public Health Emergency and the Impact on Nursing Homes

On July 23, 2020, the current Public Health Emergency was renewed for an additional 90 days.   With this renewal, the 1135 waivers for skilled nursing facilities will continue.

Some of these important waivers include:

  • The easing of the three-day hospital stay as a precondition for nursing home coverage
  • Timeframe requirements for Minimum Data Set assessments and transmission
  • Waive pre-admission screening and annual resident review
  • Physician visits

However, the 1135 waiver pertaining to submitting staffing data through the Payroll Based Journal system terminated effective June 25, 2020.

Also, the increased federal Medicaid match of 6.2% will continue under the extension of the emergency declaration.
